What the U.S. Trustee Does
The United States Trustee (UST) is a component of the Department of Justice that oversees the administration of bankruptcy cases. Key functions:
- Appoints trustees: The UST appoints Chapter 7 and Chapter 13 trustees in each district.
- Reviews fee disclosures: The UST reviews attorney fee disclosures under Section 329 and can move to disgorge excessive fees.
- Monitors means test compliance: The UST reviews means test filings and can move to dismiss cases for abuse under Section 707(b).
- Audits cases: The UST conducts random audits of bankruptcy filings to detect fraud.
- Supervises Chapter 11 cases: The UST monitors debtor-in-possession compliance, appoints creditors' committees, and can seek conversion or dismissal.
