What Happens at a Chapter 13 Confirmation Hearing
The confirmation hearing is where the judge decides whether to approve your Chapter 13 repayment plan. Here is what to expect:
- Trustee's recommendation: The Chapter 13 trustee will either recommend confirmation or state objections
- Common objections: Plan does not commit all disposable income, fails the best interests test, payment amount is not feasible, or does not properly treat secured claims
- Your response: You (or your attorney) must address each objection. This may require amending the plan.
- Confirmation order: If the judge approves, a confirmation order is entered and the plan becomes binding on all parties
